By accessing and using beattracker.com ("BeatTracker", "we", "our", or "us"), you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our service. These terms apply to all visitors, users, and subscribers of the platform.
BeatTracker is a software-as-a-service (SaaS) platform that monitors music charts on Beatport, Spotify, and other supported platforms. The service aggregates chart data and provides notifications, tracking, and analytics to artists, labels, and music industry professionals. BeatTracker offers both free and paid subscription tiers.
To access certain features of BeatTracker, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4.1 Free Tier. BeatTracker offers a free tier that provides access to chart browsing, search, and artist/label profile viewing. The free tier does not include email notifications or tracked items.
4.2 Paid Subscriptions. Paid subscriptions provide additional features including email notifications for chart placements, tracked artists/labels, and other premium functionality as described on our pricing page.
4.3 Billing. Paid subscriptions are billed in advance on a recurring basis (annually or as stated at the time of purchase). Payment is processed through Stripe, our third-party payment processor. By subscribing, you authorize us to charge your payment method on a recurring basis.
4.4 Price Changes. We reserve the right to modify subscription pricing. Any price changes will not affect your current billing period. Existing subscribers will be notified at least 30 days before any price increase takes effect on their account.
4.5 Taxes. Subscription fees are exclusive of applicable taxes. You are responsible for any taxes associated with your subscription, other than taxes based on our net income.
5.1 Cancellation. You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription remains active until the end of your current billing period. No partial refunds are provided for unused time within a billing period.
5.2 Refunds. We offer a full refund within 7 days of your first subscription payment if you are not satisfied with the service. After the 7-day window, refunds are not available for partial billing periods. To request a refund, contact us at our contact page.
5.3 Effect of Cancellation. After your subscription ends, you will revert to the free tier. Your account and notification settings are preserved for 12 months in case you choose to resubscribe.
You agree to use BeatTracker only for lawful purposes and in accordance with these Terms. You agree not to:
The BeatTracker platform, including its design, code, features, and content (excluding third-party chart data), is owned by BeatTracker and is protected by intellectual property laws. Chart data displayed on the platform is sourced from third-party platforms (Beatport, Spotify, etc.) and remains the property of those respective platforms. Your subscription grants you a limited, non-exclusive, non-transferable license to use the service for its intended purpose.
Your use of BeatTracker is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information, including data processed by our payment provider Stripe. By using the service, you consent to the collection and use of information as described in our Privacy Policy.
9.1 Availability. We strive to provide uninterrupted access to BeatTracker but do not guarantee that the service will be available at all times. We may perform maintenance or updates that temporarily affect availability.
9.2 Modifications. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time. If we make material changes that negatively affect your paid subscription, we will provide at least 30 days' notice.
9.3 Data Accuracy. Chart data is sourced from third-party platforms and updated daily. We make reasonable efforts to ensure accuracy but do not guarantee that chart data is complete, current, or error-free at all times.
To the maximum extent permitted by applicable law, BeatTracker and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising from your use of or inability to use the service. Our total liability for any claim arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
You agree to indemnify, defend, and hold harmless BeatTracker, its officers, directors, employees, agents, and third-party service providers from and against any losses, costs, liabilities, and expenses (including reasonable attorneys' fees) relating to or arising out of your use of the service, your violation of these Terms, or your violation of any rights of a third party.
We reserve the right to update or modify these Terms at any time. Material changes will be communicated to registered users via email or through a notice on the platform at least 30 days before they take effect. Your continued use of the service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, you may cancel your subscription before they take effect.
We reserve the right to suspend or terminate your account and access to the service, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct that is harmful to other users, to us, or to third parties. Upon termination for cause, no refund will be provided for any remaining subscription period.
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Colorado.
